Poland confirmed the priority of the Constitution over the EU legislation. The corresponding decision was made by the Constitutional Court after analyzing the Treaty on the European Union.
The Constitutional Court of Poland has confirmed the superiority of the country’s Constitution over the legislation of the European Union. The Prime Minister of Poland, Mateusz Morawiecki, personally applied to the Constitutional Court for an appropriate explanation.
The reason for this was the decision of the EU court that changes in the Polish law “On the National Judicial Council” may violate EU law. In particular, we are talking about an amendment that gives the President of Poland the right to nominate candidates for the position of a judge of the Supreme Court.
In this regard, the Polish prime minister asked the country’s Constitutional Court to analyze the Treaty on the European Union and establish which legislation has priority – domestic or EU legislation. As a result, the Constitutional Court confirmed the superiority of the Constitution over the laws of the European Union.
Recall that Brussels is not happy with the fact that the countries of Eastern Europe are showing too much independence in matters of attitude towards migrants and people of non-traditional orientation. Also, EU officials do not like the fact that the leadership of the countries of Eastern Europe is engaged in strengthening the central government and promoting traditional values.
