Since September 21, partial mobilization has been announced in Russia. The corresponding decree was signed by the President of the Russian Federation Vladimir Putin. According to the decree, citizens who are in the reserve are subject to conscription, and first of all, those who have already completed military service.
On Tuesday, September 20, the State Duma adopted amendments to the Criminal Code of the Russian Federation, toughening responsibility for certain crimes in wartime and the period of mobilization. In particular, for non-execution of the order of the chief in wartime and for refusal to participate in military or hostilities, a punishment is imposed in the form of imprisonment for a term of two to three years.
Chairman of the Bar Association “Conscript” Denis Koksharov in an interview with Politika Segodnya, he clarified the situation regarding Russians who are subject to conscription, but are currently outside the country.
“If he is already abroad, then there will be no punishment for this person. When he left the territory of the Russian Federation, he had to fulfill one of his military duties – to be removed from military registration [в случае отъезда более чем на 6 месяцев]. And accordingly, the cases of such citizens are placed in a separate filing cabinet. Citizens are subject to any appeals already when they return, ”the expert said.
If a man still did not leave the military registration and enlistment office before a long departure (for example, when invited to work), he will not be considered a deviationist. This was told to “Politics Today” lawyer Nikita Sorokin.
“If a person is in another state for work, this is a good reason even in court. If a person is abroad, he cannot be properly notified in the Russian Federation, unless employees call him and say: “Come, we will mobilize you now.” Therefore, the issue of evasion is so relative,” the expert said.
Earlier, the Ministry of Digital Development of Russia excluded the distribution of agendas through the State Services service. The department explained that the necessary legislative framework for this is missing. At the moment, subpoenas can only be served in person.
At the same time the lawyer Pavel Chikov in his Telegram channel, he recalled the law that prohibits citizens liable for military service from the moment the mobilization is announced to leave their place of residence without the permission of the military registration and enlistment office.
According to the head of the Ministry of Defense of the Russian Federation Sergei Shoiguabout 300 thousand people will be called. This is about 1% of the total mobilization resource of Russia, which, according to the minister, has 25 million people.
