In the new academic year, educational organizations must follow the sanitary and epidemiological rules. In schools with a large number of students, they decided to delimit the flows. Some students come to the first lesson, some - to the second, the rest - to the third. In addition, in order to reduce the spread of coronavirus infection, as well as to timely identify cases of infection, non-contact thermometry is carried out in schools.
Is it possible to refuse the mandatory measurement of body temperature?
No you can not. Thermometry is a requirement of Rospotrebnadzor and one of the mandatory preventive measures in the fight against the spread of coronavirus infection in educational institutions - together with hand treatment with antiseptics, frequent ventilation, air treatment with a recirculator and separation of different classes.
According to the federal law of 21.11.2011 N 323-FZ "On the basics of protecting the health of citizens in the Russian Federation", prevention is understood as "a set of measures aimed at maintaining and strengthening health and including the formation of a healthy lifestyle, prevention of the occurrence and (or) spread diseases, their early detection, identification of the causes and conditions of their occurrence and development, as well as those aimed at eliminating the harmful effects of environmental factors on human health ”.
With the beginning of the school year, many parents began to complain about the fact that during covid control in schools, queues of students standing on the street accumulate in schools. Some began to claim that body temperature measurement is an integral part of health information, that is, personal data, the collection of which usually requires the consent of the person. However, as explained in Roskomnadzor, people give consent to thermometry by the very fact of visiting the organization, since they were notified in advance of the mandatory temperature measurement. In addition, Federal Law No. 152 of July 27, 2006 "On Personal Data" speaks of the possibility of processing personal data without providing consent, if this is necessary to protect the life, health or other vital interests of the subject of personal data or other persons.
As noted Minister of Education of Russia Sergei Kravtsov, temperature control is a necessary measure in a pandemic, but at the same time, the prevention of infectious diseases should not violate the passage regime. The head of the Ministry of Education recommended dividing children into streams, monitoring the observance of social distance and not arranging temperature measurements outside.
Why do schools need thermometry?
Viktor Panin, Head of the All-Russian Society for the Protection of Citizens' Rights in Education confirmed to AiF.ru that it is impossible to refuse thermometry. He added that, in theory, everyone should be interested in the absence of sick children in the classroom, and measuring the temperature in this case is an effective preventive measure. It is not necessary for a medical worker to conduct thermometry, Panin explained.
“At the entrance to an educational organization, measuring body temperature is a normal and adequate practice today, given the risks of the spread of coronavirus infection. We also have an autumn period when ARVI, flu, etc. begin. Therefore, if a child goes to school with a high temperature, then it is the task of medical staff and educational institutions - to protect healthy children from sick children. Against this background, it is simply pointless to give up thermometry. And if a non-contact pyrometer or thermometer is certified and has an appropriate verification document, and the device is a medical device, then anyone can measure the temperature. Many parents are not themselves medical staff, but, nevertheless, at home they measure the temperature of their child. With non-contact thermometry, it is enough to look at the device and see that the child's temperature is increased. Accordingly, further actions are already being taken by the administration of the educational institution, ”says Panin.
According to the head of the All-Russian Society for the Protection of Citizens' Rights in Education, the actions of the administration in this case are clearly spelled out in the regulations for the activities of school employees in the event of a child's illness. According to such a document, a student with a fever, cough, respiratory symptoms, etc. will be isolated in a separate room and will await the arrival of an ambulance, or his parents will be informed about his condition and he will be under proper adult supervision during the period of illness.
With what temperature are students not allowed to attend classes?
Students are not allowed to class if their body temperature is above 37.2 degrees. In this case, the following scheme of actions is provided:
- call the administrator on duty;
- isolate the child in the medical unit, if there is one at the school, if it is not there - in a specially organized office next to the teacher's room, in accordance with the recommendation of Rospotrebnadzor;
- the administrator must call the parents to pick up the child, and if they are busy - call an ambulance;
- report the incident to the regional department of Rospotrebnadzor within two hours.
