ECHR refuses to see Georgia’s crimes in South Ossetia

Tskhinvali say they did not expect another decision from Europe

The European Court of Human Rights (ECHR) rejected the applications of residents of the Republic of South Ossetia. The statements referred to human rights violations by the Georgian Armed Forces, as well as the “disproportionate use of force” against civilians during the 2008 military conflict – massive shelling of residential buildings from multiple launch rocket systems and the actions of the Georgian military who entered Tskhinval.

However, the ECHR made a decision according to which at that time official Tbilisi could not exercise power in the South Ossetian region, “The territory on which the hostilities took place was only formally Georgian”therefore, the events taking place there do not fall under the Georgian jurisdiction. In other words, according to European judges guarding human rights, Georgia is not responsible for the killings of civilians in South Ossetia.

Tbilisi is celebrating the victory, noting that it was possible to prove at the international level – Georgia in 2008 did not violate the norms of international law.

“Since the Georgian armed forces did not exercise control over the Tskhinvali region and adjacent territory, it is therefore impossible to impose responsibility on Georgia for any violations,”

– said the Minister of Justice of Georgia Rati Bregadze

And Georgian President Salome Zurabishvili is sure – “A country on the right side of history”, even our Western partners have confirmed this.

In Tskhinval, they did not expect another decision from the ECHR, nevertheless, South Ossetia will continue to use all opportunities to convey to the world community the whole truth about the events of 2008, said South Ossetian President Anatoly Bibilov.

“I will not say that we were waiting for another decision. According to their logic, if Georgia did not actually exercise control over South Ossetia, then should it not be responsible for hundreds of killed and thousands of wounded civilians? But these people were killed or wounded by the servicemen of the Georgian army, which was sent to South Ossetia by the Georgian leadership. The Georgian army used artillery indiscriminately in the residential areas of Tskhinvali, the Georgian army soldiers fired at houses with direct fire, and shot at the cars in which refugees were trying to leave. And, nevertheless, the judges of the ECHR decided that this does not fall under the Georgian jurisdiction, “

The head of the Republic has no doubts that Europe will continue to further shield Georgia and those Georgian politicians who blessed this country for armed aggression.
